This Privacy Statement applies to all personal data that Barry Emons processes from anyone who has (had) contact with Barry Emons. Barry Emons includes the websites and applications listed below:

3. What are personal data?

Personal data is any data that can be traced back to you as an individual or someone you are responsible for. Think of your name, phone number, address or e-mail address. But data such as your IP address or Barry Emons customer number are also personal data. And other data unique to you, such as your Barry Emons order history or surfing habits.

4. From whom do we process personal data and how do we obtain it?

We process the personal data of anyone who has (had) direct or indirect contact with Barry Emons, such as (business) customers. We receive the data in different ways:

  • When we create a quote or order. Customers call or email us or you have a meeting with a consultant. We record the required data in AFAS our ERP system.
  • When you visit our website, create an account and enter certain information or when you contact our customer service.

We never receive you data from others.

5. What data do we process from you or a client/resident, what do we use it for and how long is it kept?

Data arising from the advice and quotation/order process:
Barry Emons works for a wonderful but also vulnerable target group. We are aware of this. In the advice and quotation/order process, data are sometimes exchanged about the behavior of a client/resident. It is up to the responsible person or administrator to determine what he/she wants or is allowed to share. We have the responsibility to remove this data as soon as possible from the mailbox of the advisor in question and from AFAS the ERP system in which the quotation and order is recorded. Notes on paper are recorded digitally in our ERP system and then destroyed in our paper shredder so that they are unreadable and cannot be replicated. Our retention period for such data is 12 months.

Data for processing your order:
If you order, rent or want to try something, we need certain data from you in order to deliver your order and keep you informed about your order. We also need this information for any complaints, returns and/or repairs. For this we collect your name, e-mail address, delivery address(es), payment information and your phone number. If it concerns a quotation or order for a resident of an institution, we sometimes also record the name for whom the product is intended. The information is needed to carry out the agreement you have made with us. By law, we must keep the data related to your order for 7 years.

Data in your account on our webshop(s):
In your personal account, we store the following data: name, (delivery and residential/office) address(es), phone number, email address, date of birth (if you provided it), and payment information. In your account we also save your order history including chosen delivery options. The accounts on our webshop are synchronized with our ERP system. This is necessary because all orders (including webshop orders) are processed through our ERP system. The data stored in your account is therefore also stored in our ERP system.

We want to make our customers’ lives easier and more enjoyable. Therefore, we keep the data in your account for as long as you are an active customer with us. If you have not logged in with us for 7 years, we will delete all your data. In addition, you can request the deletion of your data at any time by sending an email to info@barryemons.nl.

Data about your contact with Barry Emons customer service/advisors:
We can help you faster next time by keeping your data. We only do this in exceptional cases. We do not record regular traffic about, for example, a delivery time and the like. We keep other notes about customer contact for as long as you are an active customer with us. You can call or e-mail us.

A telephone conversation may be recorded for training and analysis purposes. We have a legitimate interest in using these interactions to improve our services. If this is the case, this will be announced prior to the call. We store the phone call for 1 month.

When you send us a private message via Twitter or Facebook, the messages are kept by us for up to 6 months, or shorter if you delete the message yourself earlier.

Data for an optimal shopping experience on our site:
Our online store contains more than 2,000 items. Therefore, we would like to help you find what you are looking for among all these items.

First of all, we make sure that our website works properly and is secure so that you can store optimally online. Communication with our webshop is done via encryption (Secure Socket Layer). You can recognize this by the padlock in the browser bar or by the fact that the letters https:// are shown before the website name.

To optimize the shopping experience, when you visit our webshop(s) we collect your IP address, information about your Internet browser, any language settings and information about the settings of the operating system of the computer or mobile device you use to visit us. Therefore, we keep this data for as long as you are an active customer with us. If you have not logged in with us for 7 years, we will delete all your data. Improve the shopping experience based on general information and sales statistics:
When you view an item on Barry Emons’ site, you will also see other items we recommend (for example, under the heading “Best Sellers,” “Customers Also Viewed,” or “Last Viewed”). These recommendations are based on the article or category you are currently viewing. Based on statistics, we know that customers who bought or viewed that item were also interested in the other items. These recommendations are not personalized but based on general statistics: everyone viewing that article sees the same recommendations. Or we show you what other users were looking for based on your search.

Self-set preferences in your account
You can indicate your own preferences to us in various places. For example, you can subscribe to our newsletter, which appears 8 times a year. Or include items in a wish list for later. You also have the option of indicating the following in your account:

  • Your preferred method of payment (IDEAL, Credit Card, Wire Transfer, and so on)
  • your primary billing address
  • your primary delivery address

You can adjust the above yourself at any time after logging into your account.

Reviews (ratings):
Reviews we love to see and so do other customers. Because reviews help you find what you are looking for and in your decision.

When you write a review, you choose whether your personal name is visible to other visitors, or you can use an alias. We ask for your e-mail address so that we can send you a verification e-mail of your review. We do this so that we can be sure that you yourself left a review on our site and not someone else used your e-mail address. Only after you have verified your review by clicking on the link in the email received from us will your review be sent to us. We will release your review after we have verified it. We may also contact you as a result of your review.

Because reviews are valuable to customers for a long time, we keep a review until you ask us to remove the review.

6. Newsletters and personalized emails

We send out a newsletter 8 times a year with interesting content topics, new products and sometimes special promotions. We like to share these via email. You can subscribe to this newsletter via our webshop(s). You can also unsubscribe at any time by unsubscribing at the bottom of the newsletter or by sending an email to info@barryemons.nl.

7. Social media

If you use social media such as Facebook, ‘like and share’ buttons on Barry Emons allow you to share articles you like, find useful or helpful with your friends on your social media account. Barry Emons does not gain access to your social media account. We encourage you to carefully review the privacy policies of the social media parties where you have an account so that you know how your data will be used and how to adjust your settings.

8. With whom will your data be shared?

To handle your order, we work with distribution partners such as DHL, Kusters BV, PostNL and sometimes other logistics service providers. These parties receive your customer number, order number, name, delivery address and phone number to ensure that they can properly process your package.

We also share your data with the payment provider if you place an order with us through the webshop. Our payment provider receives the following data (depending on the payment method chosen):

  • your first and last name
  • address information (billing, branch and delivery addresses)
  • email address
  • phone number
  • gender
  • date of birth
  • IP address
  • Account information (including IBAN).
  • Card number (encrypted)
  • Purchase data (product and/or service information).

This data is required for proper processing of your order payment. We work on the basis of a processing agreement with our payment provider. If you wish, we can provide you with a copy of this agreement.

Otherwise, we only provide data to third parties with your express consent or if we are required to do so by laws and regulations, we are compelled to do so as a result of litigation and/or in the event we deem it necessary to protect our own interests.

9. Where do we store your data?

We store your data within the European Economic Area (“EEA”) and only with certified partners.

10. How will your data be secured?

Barry Emons takes many measures to secure your personal data. Both organizationally and technically. We have contracted specialists who work daily to secure our systems and search for vulnerabilities. Through strict access control, we ensure that your personal data is only accessible to employees for whom it is necessary for them to work with it. If you feel this is not happening, please let us know at info@barryemons.nl.

11. How do we handle children’s data?

Our services are not directed at children. This means that use of Barry Emons by customers under the age of 18 is permitted only with the express consent of a parent or guardian.

12. What rights can you exercise regarding your data?

Right to information:
You have the right to a comprehensible and transparent explanation of how we handle your personal data and what rights you can exercise in that regard. In this privacy statement, we have therefore explained in detail which data we collect from you and how we handle your data.

Right of access:
You have the right to request access from us at any time to the information we have available about you. You can request this by sending an email to info@barryemons.nl. We will process requests within 30 days at the latest.

Right of correction:
You have the right to have your personal data corrected if it is incorrect or outdated and/or to have it completed if it is incomplete. You can do this 24/7 by sending an email to info@barryemons.nl or you can change or complete your data yourself when you have an account on our webshop(s).

Right to object:
You have the right to object to the processing of your data if you disagree with the way we process your personal data. This right applies to the data we use for direct marketing. For example, you can ask us to stop using your data for personalized recommendations on the website. You can arrange this by sending an email to info@barryemons.nl. In addition, this right also applies to other data we use from you based on our legitimate interest. For example, you can choose that we forget and continue to forget data about your surfing and search behavior. You can also arrange this by sending an email to info@barryemons.nl. We process requests within a maximum of 30 days.

Right to data portability:
You have the right to receive data that you have given to us in connection with the agreement(s) you have entered into with us in a machine-readable format, so that you can keep this data in a database belonging to you or another party. This includes your name, address and residence information and order history. We offer you the opportunity to request this data in a machine-readable format by sending an email to info@barryemons.nl. We process requests within no more than 30 days.

Right to restriction:
You have the right to request restriction of the processing of your data. This means that we may keep your data but not use it. This right arises in a number of cases. If you believe that this is the case, please contact us.

Right to be forgotten/request account deletion:
You have the right to request that we delete any data we hold about you. When you make a request to delete your account, we will delete data traceable to you other than the data we are required or permitted by law to retain. We offer you the opportunity to make a request by sending an email to info@barryemons.nl.

Right to file a complaint:
You have the right to file a complaint about how we handle your data. If you have a complaint, we prefer to resolve it with you ourselves.
